그동안 안녕하셨지요? 방글라데시의 의류 노동자들의 최근 역사적인 투쟁을 전합니다.


방글라데시 의류 공장에는 지난 30년 동안 노예와 복종만이 계속 반복되어 왔습니다.

최근 GWUF( Garment Workers Unity Forum) 는 이러한 의류 공장에서의 억압에 맞서기 위해 강력한 노동자들의 반란을 조직했습니다. 이 투쟁은 지난 5월 11일, 가지풀(Gazipur) 지역의 스리푸르(Sripur) 타나에 있는 스웨터 공장 노동자들이 투쟁을 이끌면서 시작되었습니다. 이 스웨터 공장에는 5000여명의 노동자들이 고용되어 있습니다. 투쟁의 과정에서 그 공장의 사장은 5월 12일에 노동자들의 요구를 받아들였고, 노동자들은 5월 13일에 일을 다시 시작했습니다.

그러나 노동자들의 요구를 수용한 뒤에, 사장은 수 많은 노동자들에 대한 허위 고소를 하여 소송을 제기했습니다.

5월 18일 밤, 5명의 노동자들이 허위 소송으로 인해 집에서 경찰에 의해 연행되었고, 이에 노동자들은 모든 허위 소송을 철회할 것과 연행자 석방을 요구하며 파업을 거행했습니다.

5월 19일 GWUF는 가지풀에서 집회를 열고, 시위를 했습니다. 5월 19일, GWUF의 무쉬레파 미슈(Mushrefa Mishu) 위원장은 스웨터 공장의 부장에게 전화를 하여, 협상을 통해 문제를 해결할 것을 요구하였습니다. 그러나, 사장은 협상에 나서지 않았습니다.

다음 날인 5월 20일, 평화롭게 파업을 했던 노동자들에게 허위 소송을 제기했던 사장과 경찰의 공모로, 3명의 노동자들이 죽었습니다.

이러한 살인 행위에 항의하며, 노동자들의 저항은 거대한 투쟁으로 전환되었습니다. 살해에 대한 분노와 더불어, 다른 지역의 모든 의류 노동자들이 지난 30년간의 억압에 대한 강력한 저항을 터뜨린 것입니다. 수백 만 명의 노동자들이 공장에서 나왔고, 11가지를 요구사항을 외쳤습니다.

5월 23일, GWUF는 가지풀 지역의 의류 산업 전체에 전면적인 파업을 요청했습니다. 이에 지난 30 여 년간 착취를 당해왔던 노동자들은 다카, 사바, 아슐리아 그리고 가지풀에서 11가지를 요구를 외치며 투쟁에 돌입하였습니다. 그 요구 중에는 EPZ(수출 자유 지역) 내에서 ‘노동자 복지 연합’이라 불리는 단체를 만들 권리에 대한 내용도 있었습니다. 그럼에도 불구하고 노동자들은 업주들에 의해 더욱 탄압받았고, 그 결과 5월 22일 사바와 아슐리아의 노동자들 또한 투쟁에 결합하게 된 것입니다.
5월 23일 GWUF의 위원장 무쉬레파 미슈가 가지풀에서의 파업투쟁을 이끌었다는 이유로 구속되었습니다.

가지풀 지역의 지도부인 하밀라 베굼, 샤히둘 그리고 하쉬불을 포함한 백 여 명 이상의 노동자들이 연행되었고, 11개의 소송이 그들 각각에게 제기되었습니다. 가지풀 지역에서 19개, 아슈일라 지역에서 7개의 소송이 무쉬레파 미슈에게 제기되어져 가지풀 지역에 있는 감옥에 던져졌습니다. 그녀는 비위생적인 상태로 구금되어졌고, 심지어 화장실에 가는 것 조차 허락되지 않았습니다. 또한 음식, 약 그리고 심지어 마실 물조차 공급받지 못했고, 조직의 다른 활동가들과 대표들, 심지어 친척들도 만나는 것이 허락되지 않았습니다. 이는 모든 국가의 그리고 국제적으로도 심각한 인권 침해입니다.

5월 24일, 무스레파 미슈, 5명의 노동자 그리고 할리마 베굼은 5일 동안 재유치 되었습니다. 재유치 과정에서, 경찰은 그녀로부터 거짓 진술서를 강제로 받기위해 노력했습니다. 경찰은 그녀의 지휘 하에 모든 난폭한 행위, 방화 그리고 1천만 다카(한화: 1억4천 만 원)에 이르는 공장 물건의 손실이 발생했음을 실토할 것을 강요하는 압력을 가했습니다. 또한 죽음에 대한 위협도 했습니다. 그러나, 실제로 GWUF는 살해당한 노동자들의 문제와 11개 사항을 요구하며 평화적인 시위를 지속하고 있었으며, 오히려 사측이 평화적인 파업을 파괴하기 위하여 채용한 깡패들을 동원하여 공장을 부수고 광폭한 행동을 만들었던 것입니다.


GWUP의 지도 하에 전례 없는 노동자 투쟁에 대한 엄청난 탄압 속에서, 무쉬레파 미슈 위원장은 수도 다카에 인접한 지역인 가지풀에서 구속되어졌고, 그녀의 구속 이후 투쟁은 더욱 확산되어 더 많은 지역에서 투쟁이 전개되었습니다.

이에 정부와 업주들은 노동자들의 투쟁에 굴복하여, 노동자들의 법적인 요구를 승낙하는 삼자회의(노, 사, 정) 를 열었습니다. 노동자들의 강력한 항의와 시위로, 정부는 GWUF의 위원장인 미슈를 일시적인 보석으로 풀어주게 되었습니다. 그러나 현재 그녀에게 걸려있는 모두 26개의 허위 소송은 여전히 철회되지 않았습니다.

무쉬레파 위원장은 보석을 통해 임시로 풀어진 후, 여러 사람들로부터 총기로 죽이겠다는 전화 위협을 당하고 있습니다. 그녀는 폭력적인 말들을 반복해서 들어왔습니다. “당신이 1천만 다카에 이르는 나의 자산을 파괴했다.” “당신의 목숨을 살려둘 수 없다.” “당신은 허위소송으로 감옥에 갇히지 않을 것이고, 오히려 노동자 투쟁을 죽이고 진압하기 위해 RAB(정부의 특수 경찰)에 의해 총기로 사라지게 될 것이다.” “살고 싶다면 지도부를 포기하라.” 무쉬레파 미슈 위원장은 이렇게 전화로 반복되는 위협을 참을 수 없는 지경에 이르렀고, 그녀의 가족 또한 극단적인 위험을 느끼고 있었습니다. 어느 날, 그녀에 대한 이러한 일들이 한 일간지에 나면서, 그녀는 다시 위협받고 있습니다. “너는 일간지에 그 사실을 알리면 중지될 것이라 생각하냐? 죽음이 이미 너의 피할 수 없는 운명으로 게시되어 있다.”


노동자들의 투쟁 속에 성립된 삼자 회의는 5월 24일 처음으로 진행되었고, 6월 1일과 4일에 두 번째와 세 번째 회의가 있었습니다.

사장들과 정부는 삼자 협상에서 GWUF에 의해 요청된 많은 요구를 받아들였습니다. 이 요구들 중에 다음 사항이 받아들여졌습니다.
주휴일, 모성 휴가, 임금 위원회 형성, 최저임금 보장, 노동조합건설 권리, 노동자와 사용자 사이의 이해에 의한 회사 운영, 노동자 신분증, 계약서, 8시간 노동, 2시간 잔업, 잔업 및 야간 수당 보장, 성과급 인상, EPZ(수출 자유지역) 내 공장을 위한 BEPZA 건설, 성폭행 및 여성노동자 학대 중단 등입니다.

GWUF의 공장 조사 위원회는 이러한 합의된 요구 사항이 방글라데시 전지역의 모든 공장에서 올바르게 수행되는 지에 대해 감시 감독할 것입니다. 정부와 업주들은 한달 안에(6월 안에) 수용된 요구사항들을 수행할 것을 수용했습니다. GWUF는 명기된 시간 안에, 삼자간 협약을 집행하기 위하여 시위하고 있고, 진행된 사항을 명백히 하고 있습니다. 조사 위원회는 올해 7월부터 그 기능을 개시할 것입니다. 이 위원회는 각각의 다른 지역 있는 의류 공장들을 정기적으로 조사한 후에, 이 협약이 수행되고 있는지 아닌지에 대한 조사결과를 세달 간격으로 기자회견을 통해 밝힐 예정입니다. 위원회는 또한 공장에서의 안전하고 건강하게 일 할 수 있는 노동 조건이 보장되는지에 대해서도 조사할 것입니다. 따라서 협약을 제대로 따르지 않는 공장에 대해 리스트를 만들 것이고 이러한 공장들에 대해서 GWUF는 삼자간 협약을 수행하도록 강제하기 위한 강력한 투쟁과 시위를 시작할 것입니다. 이 공장 조사위원회는 의사, 변호사, 언론인, 대학생, 여성 그리고 노동자 대표들로 구성될 것입니다.

최근 우리는 투쟁 속에서 노동자들의 삶을 보호하고 노동자들의 안전과 안정을 보장하는데 실패한 정부에 대해 항의해왔습니다. 정부가 공장 조사를 위해 수백만 다카를 쓰고 있음에도 불구하고 어떤 결과도 얻지 못하고 있는 것은 당연합니다. 의류 산업이 시작된 이래로 지난 30년 동안, 정부는 노동자들의 이익을 보장하고 노동자들의 삶을 보호하기 위한 어떠한 효과적인 대안도 마련하지 못했습니다. 그래서 의류공장의 업주들은 나날이 흉악해지고 있습니다.
정부에 의해 임명된 공장 조사관들은 의류업계 업주들과 즐기고, 다양한 부정부패를 자행하느라 바쁩니다. 그들이 통제되지 않은 채 위세를 떨치고 있는 상황에 맞서, 우리 GWUF는 우리 조직을 대표하여 의류 공장들을 조사할 101명의 공장 조사 위원회를 만들었고, 이 위원회는 의류 공장에서 건강하고 안전한 노동조건이 보장되는지에 대해 조사할 것입니다. 위원회는 또한 노,사,정 삼자간의 협약을 올바르게 적용되는 것을 빈틈없이 감독할 것입니다.

Sincere greetings, how are you?
Hope you have informed the recent movement of garment workers in Bangladesh.
I wish to inform you the real history of our movement.

In the garment factories of Bangladesh, subjugation and slavery have been going on over the last 30 (Thirty) years. Against these oppressions in the garment factories, recently massive workers?uprising as taken place under the leadership of the GWUF. The episode of this uprising broke up on 11 May drawing the movement of worker in the 멑S Sweater Factory?of Sripur thana (Police Station) under Gazipur district. In this Sweater factory, as many as 5000 workers are employed. Upon movement, as the owner of the factory accepted the workers demand on 12 May and the workers resumed production from 13 May. But, behind the acceptance of workers?demand, the owner filed false cases against 35000 workers. In midnight of 18 May, police arrested 5 workers from their homes. Against these, to withdraw all the false cases and to release al the arrested, the workers observed strike. The GWUF held a rally and made demonstration in Gazipur on 19 May. On the day 19 May, Mushrefa Mishu,! President of the organization Garment Worker Unity Forum (GWUF) repeatedly requested over telephone to the director of FS Sweater factory to resolve the problem through discussion. But the owner did not sit for discussion. Next day on 20 May when I was talking to Deepa in my home at Dhaka, police at the direction and in collusion of owner fired on the peaceful striking workers and killed 3 workers.

Against this action, the workers protest turned to a militant movement. In protest of besides this killing, the workers in different areas burst into strong protest against the long-30 years oppression. Millions of workers came out of the factories, demanding their 11 points. On 23 May, the GWUF called an all-out strike in the garment industry of Gazipur district. But due to deprivation of 30 years, workers start movement in Dhaka, Savar, Ashulia and Gazipur in realizing their 11-point demand. Though there is a so-called right to form an organization named 밯orkers welfare Association?in the Export Processing Zones (EPZs), workers became more repressed by owners. As a result, on 22 May workers of Savar and Ashulia went for movement.

On 23 May, the president of the GWUF was arrested for her leading strike staying at Gazipur. More than one hundred workers including the Gazipur branch leaders of the organization- Halima Begum, Shahidul and Hasibul were arrested. 11 cases were filed against each of them. As many as 19 cases have been filed against Mushrefa Mishu in Gazipur thana (PS) and 7 in Ashulia. Mushrefa Mishu was thrown to lock-up at Gazipur thana. She was confined to such an unhygienic condition, which is not even suitable for having toilet. She was not provided and food, medicine and not even water to drink. She was not allowed to meet the activists and leaders of the organization and even close relatives.

Which is a serious violation of all national and international human rights. On 24 May, Mushrefa Mishu, 5 workers and Halima Begum were taken to 5-days remand. In the remand, police tried to take forcibly false confessional statement from her. Police exerted force to confess, 밃ll the rampage, fire arsons and damages of factory goods of crore taka happened at my direction.?She also threatened with death. But, in fact, the GWUF was continuing a peaceful strike to protest against workers killing and 11-point demand. Owners, out to sabotage the peaceful strike of the organization, created!
the entire rampage and damage of factories by hiring hoodlums. After her release on temporary bail, Mishu is being threatened with death in 밅ross-fire?over cell phone from various members. She was threatened repeatedly with abusive words such as. 밳ou have destroyed my asset of crore Taka. You won뭪 be spared. You cannot be kept in Jail by false cases, so you will be vanished in Crossfire by Rapid Action Battalion (RAB) (a force created by the government) to kill and squash people뭩 movement.

You will give leadership should you are allowed alive? Wantt workers rights.....(slang)??Mushrefa Mishu became unbearable with these repeated threats over telephone. Her family is feeling extreme insecure. After publication of news of this matter in some daily newspapers, again she is being threatened, 밆o you think you will be let-up for publishing news in daily newspaper?. Death have already written up at your fate.?br> Let me allow to inform you the Achivement of the Recent Movement and Next Actions

In the wake of recent movement, and against the backdrop of government total failure to protect workers life and ensure safety and security of workers, our organization GWUF has taken some steps. It is to be mentioned here that, the government is spending millions of taka for the Factory Inspectors but it does not yield any result. No government took any effective measure to ensure workers interest and protect their lives for last 30 years since the build up of the garment industry. So, garment owners became atrocious day by day.

The appointed Factory Inspectors by the state remain busy with pleasuring garment owners and engage themselves multiple corruption. Against this uncontrolled prevailing situation, our organization the GWUF has formed a 101-member 멑actory Inspection Committee? who will inspect the garment factories on behalf of the organization. The committee will inspect whether healthy and secured working condition is ensured in garment factories or not. This Committee will also be vigilant to supervise the 멦ripartite Agreement?(government, factory owners and workers leaders) is being implemented properly.
Detailed information and the Background of this Tripartite Agreement are as follows- At the tremendous pressure of the movement and unprecedented workers uprising under leadership of the GWUF, Mushrefa Mishu was arrested (also mentioned earlier) from Gazipur district adjacent to the capital city Dhaka.

After her arrest, the movement got impetus and triggered more everywhere. And the government, owners were compelled to comply with the workers some lawful demands. And under the strong protest and demonstration, the government became bound to release the president of GWUF, Mushrefa Mishu on temporary bail recently but all the 26 false cases are still unwithdrawn. The tripartite meeting held its first meet on 24 May, and the second and third one on 1 June and 4 June respectively.

Owners and government have accepted many demands placed by the GWUF in the tripartite agreement. Among the placed demands following have been accepted- weekly holiday, maternity leave, formation wage board, ensure minimum wage, right of trade union, run factory by understanding between workers and owners, workers identity card, appointment letter, 8 hours working time, 2 hours overtime, ensure overtime bill, night bill, increase Piece Rate, establish BEPZA roll for EPZ factories, stop sexual harassment, and abuse to women workers etc. This Factory Inspection Committee of the GWUF will supervise and monitor whether the accepted demands of the organization are being implemented properly in all factories across the country, or not. The government and factory owners committed to implement the accepted demands in one month (within June). The GWUF is demonstrating and bringing out procession regularly to execute the 멦ripartite Agreement?within the stipulated time.

The Inspection Committee will commence its function from July this year. After every regular inspection of garment factories in different specific area, this committee will meet a press conference at every three months interval to public the findings, whether this agreement is being implemented or not. This committee will also inspect the safe and healthy working environment is factory is ensured or not. The Committee will prepare a list of non-compliant factories. And against these non-compliant factories, the GWUF will start waging militant movement and demonstration to force them in implementing the Tripartite Agreement. This Factory Inspection Committee will consist of doctors, lawyers, journalist, university students, women and workers leaders.
